Kebebasan Transit Bagi Land-Locked State: Pelajaran Dari Nepal

Penelitian ini bertujuan untuk memberikan gambaran yang komprehensif mengenai bagaimana kebebasan transit yang dimiliki oleh Land-locked State diimplementasikan dan apa yang menjadi hambatan dalam pengimplementasian tersebut dengan mengambil contoh Negara Nepal. Penelitian ini adalah penelitian hukum normatif. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data menggunakan studi pustaka, sementara teknik analisis data menggunakan penafsiran hukum. Hasil penelitian menunjukkan bahwa: (1) Land-locked State, salah satunya adalah Nepal, banyak menghadapi tantangan, khususnya di bidang perdagangan internasional (kegiatan ekspor impor) karena ketidakmampuan mereka untuk mengamankan “kebebasan transit†guna memperoleh akses ke laut, khususnya kebebasan transit di pelabuhan Negara Transit; (2) berbagai tantangan yang dihadapi ini menyebabkan Land-locked State mengalami keterbelakangan secara ekonomi dan rendahnya daya saing perdagangan mereka di pasar internasional.
